Terms and Conditions

By accessing or using the StolWRX web application ("Service"), creating an account, or uploading any content, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you must not use the Service.

You must be at least 16 years of age to use the Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the Service, you represent and warrant that you meet these eligibility requirements.

To access certain features of the Service, you must create an account through our authentication provider. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify StolWRX immediately of any unauthorized use of your account.

StolWRX reserves the right to suspend or terminate accounts that violate these Terms or that have been inactive for an extended period.

The Service allows you to upload, store, and work with flight logs, waypoints, photos, GPX and related data ("User Content"). You retain all ownership rights in your User Content.

By uploading User Content to the Service, you grant StolWRX a non-exclusive, worldwide, royalty-free license to store, process, display, and transmit your User Content solely for the purpose of providing and improving the Service. This license ends when you delete your User Content or your account, except where your content has been shared with others or made public.

You represent and warrant that you have all necessary rights to upload your User Content and that it does not infringe upon any third party's intellectual property or other rights.

The Service may allow you to generate publicly accessible links to share flight tracks, waypoints, or related content. Once shared, anyone with the link may view the shared content without a StolWRX account.

You are solely responsible for the content you share through public links. You may revoke shared links at any time where the Service provides that capability. StolWRX is not responsible for any consequences arising from your decision to share content publicly.

You agree not to:

• Use the Service for any unlawful purpose or in violation of any applicable laws or regulations.
• Upload content that is illegal, defamatory, obscene, or infringes upon the rights of others.
• Attempt to reverse-engineer, decompile, or disassemble any portion of the Service.
• Interfere with or disrupt the Service's infrastructure, security, or other users' access.
• Use automated means (bots, scrapers, etc.) to access the Service without prior written permission.
• Misrepresent your identity or impersonate another person or entity.

The Service, including its design, user interface, mapping and visualization features, source code, logos, and all related intellectual property, is owned by StolWRX and protected by applicable copyright, trademark, and other intellectual property laws.

These Terms do not grant you any right, title, or interest in the Service beyond the limited right to use it in accordance with these Terms.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

The Service is intended as a recreational planning and analysis tool for backcountry and STOL pilots. It is not designed, tested, or certified for sole or operational aviation use. Flight data, GPS tracks, terrain, elevation, waypoints, and all other information presented by the Service may be inaccurate, incomplete, outdated, or corrupted.

YOU ASSUME ALL RISK ASSOCIATED WITH USE OF THE SERVICE.

You must not rely on the Service as your only source of information for flight planning or in-flight decisions. Always use certified instruments, official charts, current weather, and approved procedures appropriate to your operation.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL STOLWRX, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, STOLWRX SHALL HAVE NO LIABILITY FOR ANY CLAIMS IN CONNECTION WITH ANY AVIATION ACTIVITY, INCLUDING BUT NOT LIMITED TO FLIGHT OPERATIONS, NAVIGATION, OR SAFETY-OF-FLIGHT DECISIONS.

STOLWRX'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO STOLWRX IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED AND EIGHTY U.S. DOLLARS ($180), WHICHEVER IS GREATER.

YOU ACKNOWLEDGE AND AGREE THAT YOU USE THE SERVICE AT YOUR OWN RISK, AND THAT YOU ARE SOLELY RESPONSIBLE FOR DECISIONS OR ACTIONS TAKEN BASED ON INFORMATION PROVIDED BY THE SERVICE.

When you use the Service, certain data is collected and stored, including:

• Account information provided during registration (name, email).
• Flight logs, waypoints, photos, and files you upload, which may be stored in cloud-based storage.
• Usage data such as feature interactions and session information.

StolWRX takes reasonable measures to protect your data. However, no method of electronic storage or transmission is 100% secure, and StolWRX cannot guarantee security of your data.

StolWRX reserves the right to suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to, violation of these Terms or conduct that StolWRX determines is harmful to other users or the Service.

You may delete your account at any time. Upon account deletion, StolWRX will make reasonable efforts to remove your User Content from its systems, except where retention is required by law or where content has been shared publicly.

StolWRX may revise these Terms at any time by posting an updated version on this page. The "Last updated" date at the top of this page indicates when the Terms were last revised. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.

For material changes, StolWRX will make reasonable efforts to notify you through the Service or via email.

These Terms shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to its conflict-of-law provisions. Any legal action or disputes arising from these Terms or the Service shall be brought exclusively in the state courts located in San Luis Obispo County, California, or if federal jurisdiction applies, in the United States District Court for the Central District of California. The parties consent to the personal jurisdiction and venue of such courts, and California law shall govern all disputes arising under these Terms.
